Terms of Service

ecFence Systems sells metal fencing systems, components, and related products and services — including custom Digital Engineered Plans — primarily through direct and in-person sales. We are not currently an online retail (e- commerce) store. Orders are arranged directly with our team and are typically billed through invoices issued via QuickBooks Online, with payment collected through secure payment links provided by our payment processor, Stripe. Some products are fulfilled directly by ecFence; others are fulfilled by third- party suppliers or distribution partners located near you. Installation, when offered, is performed by independent, vetted contractors who are not employees of ecFence. We may introduce online purchasing in the future; when we do, these Terms (as updated) will apply to those transactions.

You must be at least 18 years old and able to form a binding contract to purchase from us. By ordering, you represent that the information you provide is accurate and that you are authorized to use the payment method submitted.

3.1

All prices are listed in U.S. dollars and are subject to change without notice prior to purchase. The price stated on your invoice or payment link is the price that applies to your order.

3.2

Orders are typically billed through invoices issued via QuickBooks Online, and payments are processed by our third-party payment processor, Stripe (including through Stripe payment links). By submitting payment, you also agree to the applicable terms of QuickBooks Online and Stripe. ecFence does not store full payment-card numbers.

3.3

Applicable sales tax, shipping, and other charges (if any) will be calculated and displayed before you complete your purchase.

3.4

We reserve the right to refuse, cancel, or limit any order, including for suspected fraud, pricing errors, or product unavailability. If we cancel an order you have already paid for, we will issue a refund for that order.

This Section 4 applies specifically to the purchase of Digital Engineered Plans and controls over any conflicting general term in these Terms.

4.1 What you are buying

A Digital Engineered Plan is a custom set of fencing plans prepared for the specific property you identify at the time of purchase, signed and sealed by a Professional Engineer licensed in the State of Florida, and intended to comply with the Florida Building Code in effect on the date of preparation (including applicable wind-load, footing, elevation, and dimensional requirements).

4.2 Florida properties only

Digital Engineered Plans are available only for properties located in the State of Florida. By purchasing, you represent that the property is located in Florida and that the address and details you provide are accurate. ecFence is not responsible for plans that are unusable due to inaccurate property information provided by you.

4.3 Delivery
Plans are delivered electronically as a permit-ready PDF, typically within 24–48 hours of a completed purchase. Delivery times are estimates and are not guaranteed; delays caused by incomplete or inaccurate information you provide, or by circumstances beyond our reasonable control, do not entitle you to a refund.

4.4 — ALL SALES FINAL
Because each Digital Engineered Plan is custom-prepared and your order is forwarded to the engineer immediately upon payment, all sales are final and non-refundable once payment is submitted. By completing your purchase, you acknowledge and agree that you are waiving any right to cancel or obtain a refund. This is a condition of the discounted, made-to-order nature of the product.

4.5 Permitting and approval

A permit-ready plan is a plan prepared to be submitted for permit review. It is not a guarantee that any building department, homeowners association, or other authority will approve your project, issue a permit, or refrain from requesting revisions. You are solely responsible for submitting the plans to the appropriate authority and for obtaining all required permits and approvals.

4.6 Scope and use

Each plan is licensed to you for use on the single property identified at purchase. Plans may not be reused for a different property, resold, or modified and re-sealed. The engineer’s seal applies only to the plan as originally delivered; any alteration voids the seal and the engineer’s and ecFence’s responsibility for the plan.

4.7 Engineering services

Professional engineering services reflected in the sealed plans are performed by the licensed Florida Professional Engineer of record, who remains independently responsible for the engineering judgment expressed in the sealed documents in accordance with Florida law. Nothing in these Terms is intended to limit any non-waivable obligation imposed on a licensed engineer under Florida law.

5.1

Physical fencing products and components may be fulfilled by ecFence or by third-party suppliers and distribution partners. Estimated shipping and delivery windows are provided at checkout and are not guaranteed.

5.2

Return eligibility, restocking fees, and timeframes for physical products (where returns are accepted) will be described at the point of sale or in our Return Policy. Custom, cut-to-order, or made-to-order physical items are non-returnable.

5.3

Risk of loss for physical goods passes to you upon delivery to the carrier unless otherwise stated.

Where ecFence connects you with an independent fence contractor, that contractor is not an agent or employee of ecFence. Any installation agreement, workmanship, scheduling, and warranty for installation work is solely between you and the contractor. ecFence does not guarantee the performance of, and is not liable for, any independent contractor’s work, except as expressly stated in writing.

Any estimating tool, calculator, or map-based drawing feature we provide (including our material estimator) is offered for convenience only. Outputs are estimates and may not reflect final quantities, site conditions, or code requirements. You are responsible for verifying quantities and specifications before ordering or building.

All site content, branding, designs, text, graphics, and software are owned by ecFence or its licensors and are protected by applicable law. You may not copy, reproduce, or create derivative works from our content without our written permission. Purchased Digital Engineered Plans are licensed for your use as described in Section 4 and are not transferred in ownership of the underlying engineering work product.

Except as expressly stated in these Terms or required by law, the website, products, and services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free.

To the maximum extent permitted by law, ecFence and its officers, members, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the site, products, or services. To the maximum extent permitted by law, ecFence’s total aggregate liability for any claim relating to a product or service will not exceed the amount you paid for that product or service. Nothing in this Section limits liability that cannot be limited under applicable law, including any non-waivable professional liability of a licensed engineer.

You agree to indemnify and hold harmless ecFence and its officers, members, and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the site, your violation of these Terms, or your submission of inaccurate property or project information.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or your purchase will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. The “Last Updated” date reflects the most recent changes. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms. The Terms in effect at the time of your purchase govern that purchase.
